1. Scope & Applicability

These Terms & Conditions apply to all offers, orders, and agreements concluded through the website noa.earth. By placing an order, the Customer agrees to these Terms.

2. Age Restriction

Products are strictly intended for individuals aged 18 years or older. By placing an order, the Customer declares that they meet this requirement. The Company reserves the right to request age verification and cancel orders where necessary.

3. Product Information & Disclaimer

Products are lawfully marketed in the Netherlands. All information provided is for educational and informational purposes only and does not constitute medical advice. Products are not intended to diagnose, treat, cure, or prevent any disease.

4. Customer Responsibility & Legal Compliance

Laws and enforcement practices vary by jurisdiction. The Customer is solely responsible for verifying whether purchase, import, possession, and use of the Products comply with local laws. The Company is not liable for customs delays, seizures, or legal consequences arising from local regulations.

5. Orders & Contract Formation

An agreement is concluded once the Company confirms the order. The Company reserves the right to refuse or cancel orders at its discretion, including in cases of suspected fraud or regulatory concerns.

6. Prices & Payment

All prices are stated in EUR. Payment must be completed before shipment. The Company reserves the right to correct pricing errors and pursue legal action in cases of fraudulent payment or chargeback abuse.

7. Delivery & Risk

Delivery times are estimates and not guarantees. Risk transfers to the Customer upon delivery at the specified address. The Company is not liable for carrier or customs delays.

8. Returns & Right of Withdrawal

Under EU consumer law, the right of withdrawal does not apply to goods liable to deteriorate or expire rapidly. As Products include perishable goods, they may be excluded from the standard 14-day withdrawal right. Returns are only accepted for unopened products or items damaged during transit.

9. Limitation of Liability

The Company shall not be liable for indirect, incidental, or consequential damages. Liability is limited to the purchase price of the Product concerned. The Company is not liable for misuse, improper storage, adverse reactions, or combination with other substances.

10. Health & Safety

Products are not suitable for pregnant or breastfeeding individuals, persons with a history of psychosis or schizophrenia, or individuals with bipolar disorder involving manic episodes. The Customer assumes all risks associated with use.

11. Intellectual Property

All website content, branding, digital materials, and related assets are the intellectual property of Noa Wellness. Unauthorized reproduction or distribution is prohibited.

12. Retention of Title

Products remain the property of the Company until full payment has been received.

13. Force Majeure

The Company shall not be liable for delays or failure to perform due to events beyond reasonable control, including but not limited to governmental actions, customs interventions, transportation disruptions, or supply shortages.

14. Governing Law & Jurisdiction

These Terms are governed exclusively by Dutch law. Any disputes shall be submitted to the competent courts of the Netherlands.

15. Severability

If any provision is deemed invalid or unenforceable, the remaining provisions remain in full force.

16. Amendments

The Company reserves the right to amend these Terms at any time. The version applicable is the version in force at the time of purchase.
